These Terms of Service ("Terms") govern your access to and use of the website at https://www.a2ogiftco.com/ (the "Site"), operated by Alpha 2 Omega Gift Co LLC ("we," "us," or "our"), including any purchases, custom orders, account creation, or other interactions you have with us through the Site. By using the Site or placing an order, you agree to these Terms.
If you do not agree to these Terms, please do not use the Site.
1. About Us
Alpha 2 Omega Gift Co LLC is a Black-owned apparel and gift company. We design, embroider, and print custom apparel — including district tees and embroidered sweaters for the men of Omega Psi Phi, our Keep Pushin streetwear line, and custom embroidery and printing services for chapters, line groups, and individual clients. We take pride in delivering exceptional value and quality to every customer.
2. Eligibility and Customer Accounts
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to place an order on this Site. By creating a customer account, you agree to provide accurate and current information and to keep your account credentials secure. You are responsible for all activity that occurs under your account.
We reserve the right to refuse service, suspend accounts, cancel orders, or remove content at our discretion.
3. Products, Pricing, and Quotes
Every product we sell is produced to order. We make every effort to display product images, colors, and descriptions accurately, but actual products may vary slightly due to the nature of custom embroidery, custom printing, and differences in screen calibration on your device.
Prices are listed in U.S. Dollars and are subject to change without notice. Quotes for custom orders may vary based on the final submitted designs, garment selection, quantity, and complexity of the work. A final quote will be confirmed in writing before payment is requested.
4. Orders and Payment
Full payment is required prior to the start of production. This applies both to standard products purchased through the storefront and to custom orders quoted directly with us.
For custom orders, an invoice will be issued from Alpha 2 Omega Gift Co LLC. Once payment is received, a "paid in full" receipt will be provided to you via email, and production will begin.
We accept payment through the providers integrated with our Site, including Squarespace Payments and Stripe. By submitting payment information, you authorize us to charge the applicable amount.
We reserve the right to refuse or cancel any order — including for reasons such as inventory or material limitations, errors in product or pricing information, suspected fraud, or violations of these Terms. If we cancel an order after payment, we will issue a full refund to the original payment method.
5. Production and Shipping Timelines
Production typically takes 6–8 weeks from the date payment is received to the date your order ships. Larger or more complex orders may take longer; we will communicate timelines clearly before payment.
Shipping time is in addition to production time. Once your order ships, delivery is the responsibility of the shipping carrier. We are not responsible for carrier delays, loss, or damage in transit, but we will assist you in filing claims where appropriate.
6. Custom Orders and Design Approval
For custom embroidery or printing orders, we may provide you with a digital proof or mockup before production begins. You are responsible for carefully reviewing and approving all proofs, including spelling, fonts, colors, sizing, placement, and any letters, numbers, or dates. Once you approve a proof and production begins, we are not responsible for errors that were present in the approved proof.
If no proof is required or requested, you agree that we may proceed based on the order details you submitted.
7. Returns and Refunds
Due to the personalized, made-to-order nature of every product we produce, all sales are final. We do not accept returns or exchanges for buyer's remorse, change of mind, or incorrect size selection. Defective items, damaged items, and incorrect shipments are addressed in our Return Policy.
8. Intellectual Property
Our content
All content on this Site — including logos, graphics, product designs, text, and the Alpha2Omega and Keep Pushin brand marks — is the property of Alpha 2 Omega Gift Co LLC or our licensors, and is protected by U.S. and international copyright and trademark laws. You may not copy, reproduce, distribute, modify, or create derivative works from our content without our prior written permission.
Customer-submitted content
For custom orders, you may submit logos, designs, photographs, or other materials to be embroidered or printed. By submitting these materials, you represent and warrant that:
You own the materials, or
You have all necessary rights, licenses, and permissions to use them and to authorize us to reproduce them on the products you've ordered.
You agree to indemnify and hold us harmless from any claim, damage, liability, or expense arising out of any third-party intellectual property claim related to materials you submitted.
Greek-letter and organizational marks
Greek-letter organizations, including those of the Divine Nine, hold trademark and other rights in their names, letters, crests, colors, mottos, and other marks. By placing an order for Greek-letter merchandise on this Site, you represent that you are a member of the relevant organization or are otherwise authorized to obtain and use such merchandise. You are solely responsible for ensuring that your use of any organizational marks complies with the rules of the relevant organization.
9. User Conduct
When using the Site, you agree not to:
Violate any applicable law or regulation
Attempt to access, tamper with, or use non-public areas of the Site
Disrupt the Site or its servers, or attempt to do so
Submit false, misleading, or fraudulent information
Submit content for production that infringes any third party's intellectual property or other rights
Use the Site to send unsolicited communications or to harass any person
10. Disclaimers
The Site and all products and services are provided on an "as-is" and "as-available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
11. Limitation of Liability
To the fullest extent permitted by law, in no event shall Alpha 2 Omega Gift Co LLC, its owners, employees, contractors, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or loss of goodwill — arising out of or related to your use of the Site or any product purchased from us, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of or related to a product purchased from us shall not exceed the amount you paid for that product.
12. Indemnification
You agree to indemnify, defend, and hold harmless Alpha 2 Omega Gift Co LLC, its owners, employees, contractors, and affiliates from any claim, demand, loss, liability, or expense — including reasonable attorneys' fees — arising out of (a) your use of the Site, (b) your violation of these Terms, or (c) any materials you submitted to us for production.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-laws principles. Any dispute arising out of or related to these Terms, the Site, or any product purchased from us shall be brought exclusively in the state or federal courts located in Alabama, and you consent to the personal jurisdiction of those courts.
14. Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices, technology, legal requirements, or for other reasons. When we do, we will update the "Last Updated" date at the top of these Terms. If we make material changes, we will provide additional notice — for example, by posting a notice on the Site or by sending you an email. Your continued use of the Site after the updated Terms are posted constitutes your acceptance of those changes.
